CCTV surveillance is in operation on most of our wards and buildings for the safety of staff, visitors and patients.

Our processing of surveillance systems and CCTV systems is governed primarily by the Data Protection Act 2018 and the UK General Data Protection Regulation.

We follow all laws and relevant codes of practice in relation to the use of CCTV systems or surveillance systems.

We uses these systems for the following purposes:

  • To help make premises safer for those people who visit, work and live in the hospital or premises.
  • Monitor difficult to observe areas where safety could be compromised.
  • The detection, deterrent, investigation, and prevention of crime.
  • To assist in any internal or external investigation processes including the management of complaints.

We have installed a CCTV system within most of our premises and a notice can be found on each site, where a camera is present.

All images will be held securely and confidentiality. Images will not be retained for longer than necessary in relation to the purpose for which they were made, and will be removed or erased after this period has expired.

You have the right to request a copy of recordings of you held by Pennine Care. However, we may not be able to provide these if in doing so would breach another person’s right to confidentiality, or if we do not have the technical ability to provide a copy.

Images will not be disclosed to third parties unless there is a pressing need to provide the images, and there is a lawful and proportionate basis for the disclosure. Such circumstances may include:

  • The investigation of crime.
  • The apprehension or prosecution of offenders.
  • Where the disclosure is required by or under any enactment.
  • By rule of law or by order of the court.
  • In connection with legal proceedings (including prospective legal proceedings).
  • If otherwise necessary for the purposes of establishing, exercising or defending legal rights.
